Terms and Conditions

  1. Scope and validity of the terms and conditions
    1. The terms and conditions apply to legal relations arising from the purchase of products by the person (hereinafter the Client) through the online store www.kellastuudio.ee (hereinafter the e-shop) operated by Havelik OÜ (hereinafter the Seller).
    2. In addition to these conditions, the legal relations arising from the purchase of products through the e-shop are governed by the legislation in force in the Republic of Estonia.
    3. The e-shop reserves the right to make changes to the terms and conditions. These changes are reflected on the website www.kellastuudio.ee.
    4. These terms and conditions apply from June 12, 2018.

  2. Products
    1. The prices of the products sold in the e-shop are in euros.
    2. The prices of the products sold in the e-shop include VAT.
    3. The prices and availability of the products can change without notice.
    4. The images of the products in the e-shop are illustrative and may differ from the actual products. (Minimally and depending on monitor settings)

  3. Payment for products
    1. Payments can be made by bank link, direct bank transfer and ESTO hire purchase.
    2. When paying by direct bank transfer, please indicate the order number in payment description.
    3. The submitted order must be paid within 2 working days, otherwise the order can be canceled by the e-shop.

  4. Shipping of products
    1. Shipping to Estonia
      1. The delivery of e-store products within Estonia is free if the total cost of the order is 50 € (fifty euros) or more.
      2. The delivery time is within 1-3 business days.
      3. The products will be delivered to SmartPOST, Omniva or DPD parcel machines.
    2. Shipping to Finland
      1. The delivery of e-store products to Finland is free if the total cost of the order is 100 € (one hundred euros) or more.
      2. The estimated delivery time to Helsinki is within 1-3 business days and to the rest of Finland within 3-5 business days.
      3. The products will be delivered to SmartPOST parcel machines.
    3. Shipping to Latvia and Lithuania
      1. The delivery of e-store products to Latvia and Lithuania is free if the total cost of the order is 100 € (one hundred euros) or more.
      2. The estimated delivery time is within 1-3 business days.
      3. The products will be delivered to Omniva or DPD parcel machines.
    4. The Client is required to verify the correctness of the contact details submitted before the order is made to avoid delays and misunderstandings in the delivery of the products. The Seller is not responsible for the delay in the delivery of the products and misunderstandings if the delay or misunderstanding is due to the inaccuracy of the data submitted by the Client during the order submission.
    5. The Client becomes the owner of the goods after payment.

  5. Coupons
    1. Coupons are shared by the e-shop during public campaigns or personally.
    2. The coupon validity period is shown in the terms of each coupon.
    3. The coupon may have a product-specific fixed discount, cart percentage discount, or fixed cart discount.
    4. It is not possible to use a coupon for a discounted product or for a cart containing products at a discounted price, unless specifically mentioned in the coupon terms.
    5. The coupon can be used to pay for products in full if the coupon value is equal to or greater than the sum of the products.
    6. The coupon cannot be used to pay for the shipping of the products unless it is specifically mentioned in the coupon terms.
    7. The part that exceeds the amount of the coupon and the shipping fee is paid by the Client.

  6. Return policy
    1. The Client has the right to withdraw from the contract after 14 days (hereafter, the 14-day return right) from the time of delivery from the e-shop in accordance with the terms and conditions set out below.
    2. When buying from the e-shop, the Client agrees to use the 14-day return right with the following terms:
      1. Returned products must be unused and in original packaging (the Client must open the original packaging of the product with care and without damaging it. If the package is not openable, the returned products do not need to be in the original packaging).
      2. To return the products, please send a free-form withdrawal statement to info@kellastuudio.ee to make arrangements for further actions. The product can be returned using SmartPOST, Omniva or DPD parcel machines.
      3. We will refund the returned products to the Client’s account within 14 days after receiving the withdrawal statement.
      4. The cost of returning the products is paid by the e-shop if the products are returned according to the agreed method of return.

  7. Warranty
    1. The e-shop offers 2 years of warranty for the products sold.
    2. The warranty does not cover any products or parts that are worn, destroyed by force or broken by falling.
    3. The warranty does not cover the parts that are naturally worn during use.

  8. Liability and Force Majeure
    1. The Seller and the Client are liable to each other in the cases and to the extent provided for in the legislation of the Republic of Estonia for damage caused to the other Party in violation of these conditions.
    2. The Seller shall not be liable for damages caused to the Customer or for the late delivery of the product if the damage or late delivery of the product is due to a fact that the Seller could not influence, anticipate or foresee (force majeure).

  9. Processing of personal data
    1. The Client submits the right to collect and process the Client’s personal data (name, contact phone number, delivery of the package and / or home address, e-mail address) to fulfill the obligations arising from the contract or to respond to requests/contact forms with the respective data and provide the logistics partner with personal data for the delivery of the products.
    2. The e-shop does not use the Client’s residence or location address for sending advertising and other promotional materials to the Client.
    3. The Client has the right at any time to prohibit the collection and use of his personal data, unless this is necessary to recover a claim arising from a contract or to deliver the products.
    4. The use of electronic personal data for direct mail will only take place if the Client has given a separate consent for this.
    5. Encrypted data exchange with banks guarantees the security of the personal bank characteristics for the Client and the e-shop does not have access to this data.
    6. The Client data stored in the e-shop environment is treated as confidential information. We will not disclose the clients’ data to third parties.

  10. Claims procedure
    1. The e-shop is responsible for the non-compliance or defects of the products sold to the Client for contractual terms that occur within two years from the delivery of the products to the Client.
    2. In the event of a defective product, we ask that you stop using the product.
    3. The repair or replacement of defective products is agreed between the e-shop and the Client with each other. Repair costs are covered by e-shop.
    4. The e-shop is not responsible for defects to the product caused by the Client due to improper storage of the product or as a result of its unintended use.
    5. In case of non-compliance or defects of the product, please send an e-mail to info@kellastuudio.ee specifying the name of the Client, the contact phone number, the order number and the exact description of the non-conformity or defect of the product.
    6. Claims for non-compliance or defects of the product must be submitted within two months from the discovery of the product’s non-compliance or defect.
    7. All claims will be reviewed and the Client will be contacted as soon as possible but not later than within 14 days from receiving the claim.
    8. The Client has the right to demand the reduction of the purchase price or withdrawal of the contract and refund of the purchase price from the e-shop if the products can not be repaired or replaced, the repair or replacement of the products fails, the e-shop has not eliminated the defects within a reasonable time, the e-shop has caused unnecessary inconvenience.

  11. Other conditions
    1. If the e-shop has refused to resolve the Client’s complaint or the Client does not agree with the solution proposed by the e-shop and finds that their rights or interests have been violated, the Client may submit a complaint to the Consumer Disputes Commission through the Estonian Consumer Protection Board or the court. The customer may file a complaint through himself or through a representative. The Consumer Disputes Committee’s data is:
